In the following Terms of Service, the following terms are clarified as follows:
‘We’, ‘Our’, ‘Physio Development’, ‘Mentors’ – refers to the trustee for The McManus Family Trust (ABN 29 357 189 219) trading as ‘Physio Development’ and its physiotherapists.
‘You’, ‘Your’, ‘The User’, “Users”, ‘Clients’- refers to the user of the Physio Development website and user of any content provided by Physio Development.
Terms of Service
All content (including but not limited to text, audio and video) on the Physio Development website and all communications through the Physio Development mentoring and coaching services (Services), is the intellectual property of Physio Development. All content on the Physio Development website and provided through our Services is Trademark and Copyright protected, including our logo and name. The only exceptions are images with a Creative Commons licence.
Any downloading, sharing, or distributing any content on the Physio Development website, or received through our Services, is strictly prohibited. Any reproduction of any photographs, videos or slides from our website or received through our Services is strictly prohibited, without the express written consent of Physio Development, or where alternative licensing is clearly stated.
Access to Physio Development’s Services requires you to be a registered and accredited physiotherapist in your local country. Documentation as evidence of your national registration will be requested before proceeding with or renewing, your membership, coaching or mentorship.
Physio Development takes no responsibility, and is not liable, for users not having the correct hardware and operating systems to view our website or engage with our content. Users are required to use a smartphone, tablet, mobile device, or PC or MAC based personal computer with a minimum operating system of Windows XP, Vista, Windows 7, Windows 10 or MAC OSX or later. An internet connection is also required as well as the ability to listen to any audio or video content on our site.
Physio Development reserves the right to modify or discontinue, temporarily or permanently, our website or Services (or any part thereof) with or without notice.
Physio Development may adjust the prices of our paid Services at any time, but will always give 30 days notice to all Users of paid Services, to allow them to cancel their Services if this is disagreeable.
Viruses, Hacking and other offences
You must not misappropriate our website by knowingly or unknowingly introducing viruses, trojans, malware or any other malicious material that may be harmful. This is a criminal offence and we will report Users to the relevant authorities, and cooperate with any investigations. This includes disclosing personal information (e.g. name, email address, IP addresses) to relevant authorities if requested and You consent to such disclosure. Your right to use our website, as well as any of our services will cease immediately.
Physio Development is not responsible or liable for any damage or loss that occurs to you due to any distributed denial-of-service attack, virus or other technologically harmful material that may infect your computer equipment, programs, data or other proprietary material due to your use of our site or any websites linked to from Physio Development. It is your responsibility to ensure that you use appropriate virus scanning software.
Physio Development confirms that all of our physiotherapy mentors and coaches are fully registered and accredited physiotherapists with the Australian Health Practitioner Regulation Agency (AHPRA). Physio Development and our physiotherapists will abide by the Code of Conduct for all physiotherapists registered in Australia. For more information, please visit AHPRA.
All information given on our website and in our Services is given as advice only. It is intended for the education of registered physiotherapists only. This website does not replace the need for post-graduate training, conferences, or face to face clinical training with University or higher institution training.
Any information that is disseminated from a 3rd party (e.g., clinical research) will be clearly defined, referenced, and attributed.
Physio Development endeavours to provide the most up to date information as possible, in our free and paid content. However, we do not guarantee the accuracy, reliability, and suitability of any of the information we provide through our website physiodevelopment.com and through our paid Services, as it pertains to your own clinical cases.
IT IS YOUR RESPONSIBILITY AS A CLINICIAN TO DECIDE THE APPROPRIATENESS AND SUITABILITY OF ANY INFORMATION PROVIDED BY PHYSIO DEVELOPMENT WITH REGARDS TO YOUR OWN CLINICAL PRACTICE, PHYSIO DEVELOPMENT IS NOT RESPONSIBLE OR LIABLE FOR ANY INJURY, DAMAGE, LEGAL ACTION, OR COMPLAINT AGAINST YOU BY ANY PATIENT THAT YOU ENGAGE WITH.
YOU AGREE THAT THE USE AND APPLICATION OF ANY ADVICE RECEIVED ON OUR WEBSITE OR THROUGH OUR SERVICES IS AT YOUR OWN RISK.
YOU ARE REQUIRED TO HAVE YOUR OWN APPROPRIATE LEVEL OF PROFESSIONAL INDEMNITY INSURANCE AND ARE RESPONSIBLE TO ABIDE BY THE CODE OF CONDUCT AS A PHYSIOTHERAPIST IN YOUR OWN COUNTRY AND BY THE STANDARDS OF YOUR NATIONAL REGISTRATION.
YOU UNDERTAKE NOT TO PURSUE LEGAL ACTION AGAINST PHYSIO DEVELOPMENT OR ANY OF ITS PHYSIOTHERAPISTS FOR ANY ADVICE GIVEN ON OUR WEBSITE OR THROUGH OUR SERVICES. YOU IRREVOCABLY RELEASE PHYSIO DEVELOPMENT AND ITS PHYSIOTHERAPISTS FROM ANY CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE PHYSIO DEVELOPMENT WEBSITE OR OUR SERVICES, INCLUDING ANY CLAIMS RELATING TO, OR ARISING FROM, ANY PERSONAL INJURY, PROPERTY DAMAGE OR OTHER LOSS SUFFERED BY YOU OR YOUR PATIENTS, HOWSOEVER CAUSED, INCLUDING WITHOUT LIMITATION DUE IN WHOLE OR IN PART TO OUR OR OUR PHYSIOTHERAPISTS’ NEGLIGENCE.
YOU WARRANT THAT YOUR PRACTICE OF PHYSIOTHERAPY IS PERMITTED IN ACCORDANCE WITH THE LAWS OF ALL APPLICABLE JURISDICTIONS AND THAT YOU WILL COMPLY WITH ANY REQUIREMENTS IMPOSED UPON YOU BY ALL APPLICABLE REGISTRATION BODIES AND ALL OTHER STATUTORY OBLIGATIONS.
YOU UNDERSTAND THAT NO SERVICE OFFERED BY PHYSIO DEVELOPMENT SHOULD BE TAKEN TO CONSTITUTE SUPERVISION OF YOU AND THAT PHYSIO DEVELOPMENT WILL NOT ASSUME ANY PATIENT-PRACTITIONER RELATIONSHIP WITH YOUR PATIENTS.
YOU UNDERTAKE TO INDEMNIFY AND HOLD HARMLESS PHYSIO DEVELOPMENT FOR ANY LOSS INCURRED BY PHYSIO DEVELOPMENT WHERE THAT LOSS IS ATTRIBUTABLE TO YOUR NEGLIGENCE OR BREACH OF THESE TERMS. YOUR LIABILITY UNDER THIS INDEMNITY WILL BE REDUCED TO THE EXTENT THAT THE LOSS IS ATTRIBUTABLE TO PHYSIO DEVELOPMENT.
Physio Development is not responsible or liable for any loss of profits caused by any application of our advice in your clinical interaction with patients.
Physio Development will do its best to keep the website running at all times, however, we are not responsible for any downtime of our servers or malicious attack including but not limited to a distributed denial-of-service attack.
The use of any content on the Physio Development website may use mobile data if you are not connected to the internet via WiFi or similar connection. Physio Development is not responsible for your own data use over mobile networks, and will not be responsible for any extra charges caused by mobile data use, and/or exceeding your mobile data allocation.
Physio Development receives secure payments on our website via Stripe and PayPal.
Stripe is certified to PCI Service Provider Level 1, as per its audit by a PCI-certified auditor. This is the most stringent level of certification possible. Stripe forces HTTPS for all services and Physio Development complies with these SSL requirements. Stripe has a strong reputation for identifying and blocking any fraudulent credit card transactions immediately. No credit card information is kept on the Physio Development website. All information is handled directly with Stripe.
Membership payments will be set up on a monthly subscription, payable monthly in advance. Your billing cycle will commence at the time of your sign up and completion of registration. You will not be granted access to member content or mentoring or coaching services until registration is complete and payment has been received.
Membership upgrades, and downgrades
You may upgrade or downgrade your membership level at any time. This new level of membership will commence at your next billing cycle. Please contact Physio Development through your member dashboard to change your membership level.
Cancellations and Refunds
You may cancel your membership at any time. Cancellation will take effect immediately and no further billing will occur. All of your user information will be deleted upon cancellation of your membership.
Physio Development offers an initial 30-day guarantee and a full refund on the first month’s payment if you wish to cancel your membership within the 30 day period. Any cancellation after this initial 30 day period will not be eligible for a refund.
Membership, Mentoring and Coaching Services
Physio Development agrees to comply with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). See the Privacy Act 1988 (Cth) here.
In the case of you accessing Physio Development’s Services, you agree to never disclose any personal information or health information of the client you wish to seek coaching for without the express consent of that client or as otherwise required by law. This will be a personal breach of your national physiotherapy code of conduct.
Physio Development very strongly urges you to never disclose any of this personal information or health information on our website or through any email or online communications without the express consent of the individual to whom that information pertains. If you do this, we will immediately delete this information, and your membership and access to Physio Development’s Services will cease immediately.
The only personal information that Physio Development will ever ask for in our Services is gender and age (in years). All other clinical information related to your physiotherapy case studies and clients must be entirely anonymous.
